US SEC Is Now Investigating Activision Blizzard

September 21, 2021

According to the Wall Street Journal, the US Securities and Exchange Commission has launched its own investigation into Activision Blizzard’s response to sexual misconduct and workplace harassment allegations.
The SEC reports that it has requested a variety of documents from the publisher, including Kotick’s communications with other high-level executives about the allegations. Further, the regulator wants to see separation agreements for employees who left this year, personnel files for six former employees, as well as board meeting minutes going back two years.
Activision Blizzard’s representative said the company is cooperating with the SEC investigation, noting that the agency has subpoenaed past and present employees.
“Our company has made and is making a number of significant changes in order to eliminate discrimination, harassment, or unequal treatment of any kind,” the representative said.
The SEC is investigating whether Activision Blizzard had a duty to inform investors about its investigation into workplace and gender pay gap allegations before the California Department of Fair Employment and Housing made them public.
According to the company, when the lawsuit was filed, it had been “extremely cooperative throughout the DFEH’s investigation” and the complaint was inaccurate, distorted, rushed, and in many cases false.
Activision Blizzard investors think they should have been informed sooner, as they have filed a lawsuit against the publisher alleging it “made false and/or misleading statements” and failed to disclose a number of relevant facts about the business regarding the DFEH case.
A DFEH lawsuit regarding the shredding of documents has been escalated, the Communications Workers of America has filed a complaint with the National Labor Relations Board alleging illegal labor-busting tactics, and the company’s president and global HR manager have resigned over the matter.

Thai Bits: Flooding Coming In Bangkok Soon, Thai Supreme Court Ruling Helps Release 3 Foreigners

September 21, 2021

Storm Coming To Bangkok

Due to the torrential rainfall forecast for this week, the Meteorological Department has warned of the risk of flooding in Bangkok. The capital has been experiencing rain for three weeks in a row, so the water level in eastern Bangkok canals is already high. Aswin Kwanmuang, Bangkok’s governor, says water pumps are needed to drain canals, and rubbish and weeds need to be removed to improve drainage.
Thailand’s capital’s flood response center is now operational 24 hours a day in case of flooding, according to the Bangkok Post.. Additional water pumps have been installed in flood-prone areas. Recent flooding has been reported in the capital, according to the report.
A low-pressure area is now accelerating in the South China Sea and is expected to become a tropical cyclone as it approaches the coast of Vietnam, according to the Meteorological Department. There will be heavy rain in all parts of Thailand from today until Friday. In coastal areas, waves could rise to 2 meters during thundershowers, due to a monsoon trough in the lower North, Central Plains, and the East, as well as the southwest monsoon in the Andaman Sea and the Gulf of Thailand.

Foreign Couple and A Man Arrested on Durg Charges Have Been Released From Thai Prison Due Thai Supreme Court Ruling

An Australian and Thai couple, as well as an American man who was on death row in Bangkok for trafficking crystal methamphetamine, have been released from prison. The Sydney Morning Herald reports they were accused of smuggling half a tonne of crystal methamphetamine for the Hells Angels motorcycle gang in Thailand.
Luke Cook from Western Australia, 37, arrived in Sydney last week after being cleared by the Supreme Court. Tyler Gerard, from California, returned to the United States after being cleared by the Court.
Luke Cook, who ran a bar and guesthouse in Pattaya, has been pleading his innocence since he was jailed in 2017. His father has been campaigning for his release.
It was alleged that Luke Cook was paid $US10 million by the Hells Angels to smuggle 500 kilograms of methamphetamine aboard his yacht where Tyler Gerard was said to be working as a crew hand. Police believe Cook dropped the drugs overboard when a Thai navy vessel approached, and a package containing over 50 kilograms of meth was found on a beach in Chon Buri.
The Melbourne-based Capital Punishment Justice Project has backed the defense lawyers and argued it was a setup and the men are innocent.
According to a press release published on the Pattaya News, Thailand Bail Legal Services announced that the case has been dismissed by the Supreme Court and that both Luke Cook and Tyler Gerard are out of prison and back home.
